All activities offered by Costa Rican Adventures and its agents, employees, independent contractors or affiliates (each “ CRA ” or “us”) are offered on an “as available” basis under the terms and conditions set forth herein and in the CRA Cost and Payment Information Form, as updated by CRA from time to time. In the event of any conflict between the provisions of this waiver and the Cost and Payment Information Form, this waiver shall apply. By signing below, both Participant and guardian(s) (each “you” or “your”) are agreeing to be bound to the terms and conditions of this waiver. You recognize that your complete agreement with such terms is a material basis and part of the consideration for Participant's participation in any CRA activity.
You represent to us that Participant has the physical ability to travel and to participate in all of the activities Participant chooses to engage in. You acknowledge that outdoor recreational activities pose inherent risks, dangers, and hazards, both foreseen and unforeseen. You agree that you are voluntarily participating in all activities solely at your own risk. You, and all of your agents and representatives, covenant not to sue, and hereby release, waive, and discharge any and all claims you have or may have against CRA now and in the future, except to the extent that such claims arise directly from the willful misconduct or gross negligence of Costa Rican Adventures. You agree to fully indemnify CRA for any claims arising from Participant’s willful misconduct, Misbehavior, or gross negligence.
Costa Rican Adventures assumes no responsibility for injury, loss or damage to person or property in connection with any service resulting directly or indirectly from: acts of God, detention, annoyance, delays and expenses arising from quarantine, strikes, thefts, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulations, discrepancies or change in transit or hotel services, or anything else that is not reasonably within the sole control of Costa Rican Adventures. Reasonable changes in the itinerary may be made by CRA in its sole discretion, without any liability or a duty to account for such changes, if it believes such changes are in alignment with the comfort and well-being of the participants. Notwithstanding anything else in this waiver, CRA is not liable with respect to any activity or any other subject matter related to this waiver under any contract, negligence, strict liability or any other legal or equitable theory for any amount in excess, in the aggregate, of the fees actually received by Costa Rican Adventures, for Participant’s participation in the CRA services related to such subject matter. In the event that any of the provisions of this waiver shall be held by a court or other tribunal of competent jurisdiction to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this waiver shall otherwise remain in full force and effect.
Both participant and guardian(s) understand that all rules established by CRA must be followed to ensure the safety, health, and welfare of everyone involved in the experience. Costa Rican Adventures reserves the right to send home any participant that the staff feels could be injurious or harmful to him/herself or others or conducts him/herself in a manner that is detrimental to the program. The group atmosphere is a priority to Costa Rican Adventures and its staff and requires treating everyone involved in the experience with respect. Although we may not impose strict rules of conduct, actions that prevent the group from participating in a fun, safe, and healthy experience (“Misbehavior”) may result in the participant being sent home with no refund and at your own expense. Use of illegal drugs, theft, sexual activity, and disregard of rules or instructions are all considered activities that are grounds for early dismissal.
